1. SPECIAL REPORT: Judge Roberts Nominated to Replace

President Bush has chosen John G Roberts Jr, a US Court of Appeals judge for the DC Circuit to fill the Supreme Court vacancy created by the July 1 resignation of Sandra Day O’Connor.

 

In his announcement tonight, President Bush described Roberts as, “a person who will faithfully apply the Constitution…I have found such a person in Judge John Roberts. I am nominating him to serve as an associate justice of the Supreme Court.” Bush added, “In my meetings with Judge Roberts I have been deeply impressed...He has profound respect for the rule of law. He will strictly apply the Constitution and laws, not legislate from the bench.”

 

Bush’s appeal to the standard of strict interpretation of the Constitution is in accordance with the original intent of America’s Founding Fathers. This is best explained by Thomas Jefferson, in his June 12, 1823 letter to then Supreme Court Justice William Johnson: “On every question of construction, carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates, and instead of trying what meaning may be squeezed out of the text, or invented against it, conform to the probable one in which it was passed.”

 

As has been well documented in the weeks since Justice O’Connor resigned, she clearly engaged repeatedly in inventing new meanings out of the text of the Constitution and the Framers’ original intent.

 

If he is confirmed by the Senate, let us pray that Judge Roberts will perform to the strict-constructionist-standard that the Founders intended and our nation so desperately needs.

2. REACTIONS TO JUDGE ROBERTS

While we wait for comments and reactions from our US Senators, we already predict that the battle for Judge John Roberts confirmation will be heated. Senator John Kerry’s recent comments are indicative of what we can expect in the coming months.

 

In Kerry’s July 11th email message to his supporters, he bluntly stated, “Let's make our principles crystal clear right out of the box. We will never support a Supreme Court nominee intent on reversing Roe v Wade and undoing critical civil rights protections... I will insist on a complete and full examination of the record of President Bush's nominee. And, if that nominee is intent on reversing Roe v Wade and essential Supreme Court protections for civil rights, I will use every option I have as a United States Senator to keep that nominee off the Court.”

 

In typical Kerry fashion, he deploys a manipulative and deceptive effort to gain support for his position.

 

Kerry attempts to meld the right to discriminate against and kill innocent unborn children with civil rights legislation created to PREVENT the discrimination and murder of innocent people simply because of their skin color. Four times in this short letter Kerry links Roe v Wade and “civil rights” in the same sentence. For example, he also states, “We must all commit ourselves to standing up for Roe v Wade and our civil rights.”

 

Spin-doctor John Kerry continues, “And we will never accept a double standard that says, on a decision vital to America's future, President Bush's most extreme supporters can campaign all-out while you and I are urged to be silent.” Double-standard? Here Kerry employs the frequently used “straw-man” argument by inventing a nonexistent problem, which, if it really did exist, would be so obviously wrong that everybody would support its demise.

 

Note also Kerry’s use of another oft used tactic: positioning those who wish to protect the life of innocent unborn children as “President Bush’s most extreme supporters.” Christian Patriots must not allow our opponents to define us as extremists.

 

Christian Patriots, aka traditionalists or values-voters, represent mainstream American values; we represent the core ideals upon which our nation was founded. Those who support the Supreme Court’s unconstitutional decisions, inventing rights such as abortion and same-sex marriage—while outlawing government endorsement of the Ten Commandments—are the real extremists. They are trying to change America into a nation that the Founders never intended.

 

Already, Roberts’ supporters and opponents are citing a brief he co-wrote in 1990 that suggested the Supreme Court overturn Roe v Wade, the 1973 Supreme Court decision that legalized abortion. The brief stated, “The [Supreme] court's conclusion in Roe that there is a fundamental right to an abortion ... finds no support in the text, structure or history of the Constitution.”

 

NARAL, the National Abortion and Reproductive Rights Action League, has already issued a formal statement: “If Roberts is confirmed to a lifetime appointment, there is little doubt that he will work to overturn Roe v Wade…As deputy solicitor general under the first President Bush, he argued to the Supreme Court that ‘Roe was wrongly decided and should be overruled.’”

 

On the other hand, the Associated Press reports Roberts told senators during his 2003 confirmation hearing for his DC Circuit Court nomination, for which he was confirmed, that,. “Roe v Wade is the settled law of the land...There is nothing in my personal views that would prevent me from fully and faithfully applying that precedent.”

 

Many Christian-based organizations are already lining up to support Roberts: Focus on the Family, Concerned Women for America, Family Research Council, Priests for Life, and Coalition for a Fair Judiciary.

Inform your Senators that:

 

1. We want our next Justice confirmed and in place when the Supreme Court opens its fall term October 3.

 

2. The filibuster must end; a simple up or down vote on the President’s judicial nominees is what the Constitution AND American citizens demand.

 

3. The pro-life position is consistent with the US Constitution and the mainstream American values set forth by the Founders—they should not be influenced by the real extremists such as NARAL who are bent upon creating a new (but NOT improved) America.

3. BECOME A SIGNER…TO A NEW DECLARATION
